is it OK to use IB's images for layout?

Well, I'm building a fanlisting for IB.com and I figure it would be wonderful to put up a similar layout on the fanlisting. The fanlisting is due about four more days. I've sent an email to chef@iconbuffet.com and haven't heard anything back. In the credits and disclaimer (which are on every page) I have this..
"iconic deliveries © Ilona. this site is a non-profit fan-based website. I do not claim ownership of any images used on this website, nor do I have any connection to the owner, founder, Firewheel Design Incorporated or other companies related to iconbuffet.com. no copyright infringement intended."

Once again, is it OK to use the images used on IB's layout to make another similar one? Any feedback is appreciated. If it's not OK, then I'll have to make another one from scratch. thanks in advance. =]

when you say images on IB's layout do you mean the icon sets or IB page images?

The license spells out the use of the images in the icon sets.

no, no. I mean the images which are used to build up the layout itself. not the icon sets. is this OK?

I would say no. They are copyright Firewheel and unless you get their express permission you are in violation of that copyright.

You can use the icons and the images they've provided for the referral links but that's it.

Doing something similar probably isn't very hard to do. If you prove you made the images, then perhaps you can't get sued by intellectual property stuff.

But then again, stuff on the net is show it and lose it. =P

Also, the XHTML of IB is, ummm, ok, but not the easiest to extract to rawness. > <

Thanks, JB. I've emailed them twice (chef@iconbuffet.com), but I haven't got a response. I'll try emailing them again, this time to design@firewheeldesign.com..

LOL. IB's coding is way beyond my powers. The layout I made is way much simpler and maybe rough or inefficient. ;D

Why don't you use some icons to make the layout? I belive that's allowed, correct me if I'm wrong. :)
